The News

The European Commission has issued its final approval for new rules aimed at facilitating the return of non-European foreigners who do not have the legal right to remain in the European Union. According to the Anadolu Agency, these rules aim to enhance the enforcement of return decisions and provide new procedures to facilitate cooperation between EU member states.

The new rules include the possibility of establishing return centers in third countries, allowing member states to ease the return process. They also introduce a new "European Return Order" system aimed at facilitating the recognition of return decisions between EU member states. According to the agency, recognition of return decisions will initially be optional, and the system will be reviewed three years after the rules come into effect.

An EU official stated that these rules aim to strengthen cooperation between EU member states in implementing return decisions. They added that these measures are designed to reduce the costs and complexities associated with enforcing return decisions. The new rules also allow member states to impose penalties on individuals who refuse to cooperate with national authorities, including reducing benefits and assistance provided under national law.

Additionally, the new rules permit member states to permanently bar entry to individuals who pose a security risk and detain them for more than two years if necessary. The rules also allow sending individuals subject to return decisions to return centers in third countries, provided these countries adhere to international human rights standards. According to the agency, unaccompanied minors will be excluded from these arrangements.

Analysis & Context

Analytically, these laws aim to enhance cooperation among EU member states concerning return operations. This step comes in the context of increasing pressure on European countries to address the migration and refugee crisis. By establishing return centers in third countries, the EU seeks to alleviate pressure on member states and provide more effective solutions for returning refugees to their home countries.

In a broader context, European countries face growing challenges in the areas of migration and refugees, prompting them to seek stricter and more effective solutions. These laws aim to strike a balance between the need to maintain internal security and adhering to international human rights standards.
