The News

German sportswear giant Adidas has filed a lawsuit against Australian brand White Fox, accusing it of selling and promoting clothing that bears a design similar to its famous logo. Adidas' lawyers argued in federal court that White Fox has used a design featuring four parallel lines, which infringes on its intellectual property rights. The German company stated that it had repeatedly asked White Fox to stop selling and promoting clothing with a similar design, but the Australian company refused to comply.

White Fox's lawyers stated that they intend to refute Adidas' claims, pointing out that many other Australian brands use similar designs. They also said they will mount a strong defense in court, arguing that their designs are not identical to Adidas' logo. One of White Fox's lawyers said, "We categorically deny that our designs infringe on Adidas' intellectual property rights."

In the context of the lawsuit, Adidas noted that its well-known three-stripe design has enjoyed a strong reputation in Australia since 1957. The company pointed out that White Fox has used a similar design featuring four parallel lines, which could confuse consumers. Adidas also highlighted that White Fox has used images of people wearing genuine Adidas clothing alongside its own products, which might suggest that Adidas has approved its design.

According to documents submitted by Adidas, the German company requested that White Fox cease using the similar design as early as March 2025, but the Australian company did not respond. Adidas said it aims to seek financial compensation equal to the profits White Fox earned from selling and promoting the questionable products. The company stated that it will present evidence including side-by-side comparisons of its products and White Fox's products, as well as images of billboards and bus stop advertisements.

It is worth noting that White Fox, founded by Georgia and Daniel Kontos in 2013, has seen significant growth in recent years, with sales reaching AU$542 million in the year ending June 2025. Despite this growth, the company now faces new legal challenges from Adidas, which could impact its standing in global markets.

Analysis & Context

From an analytical perspective, major brands like Adidas face increasing challenges from emerging companies that use similar designs to boost their sales. These lawsuits highlight the importance of protecting trademarks and unique designs in the world of fashion and sports. In a broader context, the case demonstrates how small companies can exploit legal loopholes or visual similarities to attract customers, raising questions about the legal protection of established brands.
