The News

President Kais Saied announced modifications to Law No. 54 concerning cybercrimes, which replaces jail sentences for those spreading false news with monetary fines. According to the modifications published in the official gazette, fines ranging from 10,000 to 20,000 Tunisian dinars (from $3,300 to $6,600) can be imposed on individuals who disseminate false information that harms public security or the rights of others. The law also imposes similar fines on those who publish false personal data or attempt to damage the reputation of others.

The amendments state that repeated offenses can result in a six-month jail sentence in addition to a fine of 50,000 Tunisian dinars (over $16,000). In cases where the victim is a public official, the fines are doubled. This modification comes after a cabinet meeting chaired by President Saied on Tuesday to discuss amendments to Law No. 54 and other legislative measures.

This decision aims to ease pressure on freedom of expression in Tunisia, where Law No. 54 has faced criticism from human rights organizations due to concerns about its impact on media freedoms. However, some see these amendments as an effort to strike a balance between protecting the right to expression and ensuring public security.

Analysis & Context

Analytically, these amendments aim to strike a balance between protecting public security and human rights. In a broader context, Tunisia faces challenges in maintaining freedom of expression amid legal restrictions. This move may help alleviate pressure on legal institutions, as monetary fines can be more effective than prison sentences in certain cases. Nonetheless, it remains crucial to monitor the impact of these amendments on freedom of expression and civil rights in the country.
